Terms and Conditions of use of BOXITSTOREIT
These Terms and Conditions ('the agreement', 'terms and conditions') are an integral part of the BOXITSTOREIT order Form and Customer Agreement to which this is attached (collectively, the Agreement). In this agreement BOXITSTOREIT is referred to as 'BISI', 'customer' refers to you, the purchaser of materials or services from BOXITSTOREIT. This agreement is the complete and full understanding between you and have ordered pursuant to the agreement.
Any other terms, conditions, warranties, guarantees, undertakings, whether express or implied by statute (insofar as such statute permits), common law and otherwise or arising from dealing or trade, custom or usage are hereby excluded from this agreement. No variation of this agreement is binding unless in writing and signed by an authorised officer of BOXITSTOREIT.
To the extent of any conflict between the terms agreement and these Terms and Conditions, these Terms and Conditions shall be controlling.
Packing Materials
BISI will deliver packing materials at the customer's request and of their choice. The boxes will then be picked up after contacting BISI by phone or by email.
Boxes not supplied by BISI for storage will be charged based upon the dimensions of the box, using BISI boxes as a comparable size to determine the applicable charge. Heavy boxes, i.e. boxes weighing over 25 kgs, will be charged a 50% surcharge at the sole discretion of BISI.
Pick Up Services
You are responsible for scheduling a two (2) hour window of time (the 'pick-up window') for BISI to pick up your boxes. BISI will send a representative to pick up the goods from your residence on the scheduled pick-up date. BISI cannot and does not guarantee the pick-up of the goods will occur at a specific time during the pick-up window.
The BOXITSTOREIT member collecting the boxes to be stored will verify the customer's identity by asking them to produce a valid form of identification.
In the event that customer is unable to be present during the pick-up window, or if the pick-up location changes the customer must provide BISI with at least 24 hours notice prior to the scheduled pick-up date. Failure to provide timely notice will result in a charge to the customer at BISI's discretion.
If the customers items are improperly packed and the customer would still like to store those items, BISI will pack or re-pack the customers items and customers shall pay an additional fee at the BISI prevailing hourly service rate. This fee will not include any packing materials used; packing materials will be charged seperately, according to BISI prevailing packing fees. Additional fees and charges will be applied if the customer lives outside BISI catchment area, which is set at a 20 mile radius from the BISI offices, as outlined on the contact page of this website.
Storage Services
BISI will store your belongings at a storage facility selected by BISI. Subject to the terms set fourth herein, BISI will store the customer's belongings between the pick-up date and the drop-off date, as specified by the customer when ordering. The storage factor is determined by the number of full and partial months during the storage period. The storage period factor for the storage period is set forth on the order form and customer agreement.
You acknowledge that you have inspected each box and each one is now in a good condition and suitable for the intended purpose of storing your goods and personal belongings. BISI is not responsible for any damage caused to a box or its contents as a result of your negligence or willful misconduct or that of your agents or representatives. You will make no additions or alternations to a box without written permission obtained from BISI.
By agreeing for BISI to accomodate your belongings, you indicate that you are the lawful owner of the items being stored or are otherwise authorised to execute this agreement on behalf of the lawful owner. Items being stored must be packaged by the customer suitably for storage purposes, and must not be prone to fire, leakage, moisture, spoilage, contamination, or be deemed as hazardous materials under any applicable laws. Any type of foods are strictly forbidden; this includes dry foods, tinned foods, bottle foods and drink(s). Any damage caused to one or more BISI storage facilities caused by infestations due to the forbidden storing of such goods will be charged at a rate at the discretion of BISI, which will include the replacement of packaging and the manpower required to repackage and restore the affected boxes.
Drop-off Services
You are responsible for scheduling a two (2) hour window of time (the drop-off window) for BISI to drop-off your boxes during the acceptable drop-off period. BISI cannot and does not guarantee that the drop-off of the boxes will occur at a specified time during the drop-off window. BISI will make one (1) attempt to deliver the customers items to the customers residence on the scheduled drop-off date. If a delivery attempt is unsuccessful due to the customer's negligence then the customer will be charged for the attempted delivery both fuel and labour costs.
Boxes that have not been delivered to the customer seven (7) days after the scheduled drop-off date shall be subject to an additional storage fee. Such an additional fee will be calculated pro rata as to the cost of the customer's belongings.
The customer may request that BISI deliver their items to an authorised third party or that BISI leave the customers items outside their residence, provided that the customer has provided the name and location of the third party authorised to accept delivery of the customers items, and the customer executes such additional documentation as required by BISI. The authorised third party must sign a release and waiver at the time of delivery. BISI is not responsible for any loss or damages to the customers items resulting from a delivery to an authorised third party.
In the event that the customer has stored items with BISI and would like them transported to another destination (e.g. via a courier such as UPS), BISI will send the items to the customer at the sole expense of the customer in addition to the standard handling fee of BISI. BISI is not responsible for any damage or loss that results from the movement of customers goods in this way.
Our Right to Access Boxes
BISI, or an agent acting on behalf of BISI, may open any of your boxes without providing prior notice in cases of emergency, inclusive of but not limited to fire, flood and other Acts of God. BISI may also be required to open your box(es) for a law enforcement or other government organisation. At all other times we will provide you with reasonable notice prior to opening a box containing your belongings.
Your Right to Access Boxes
Provided your account has been paid in full and you are not in default, you have the right to request the redelivery of any of your boxes subject to the BISI drop-off fee, available on request. Please note that BISI requires a minimum of 24 hours notice in order to accommodate all such requests, and that you will be required to confirm your identity by means of acceptable form of picture identification before BISI representatives will allow you to receive your goods.
Payment
The customer agrees to pay the total cost of the services provided by BISI, plus applicable taxes, in accordance with the payment terms. Pricing can be found on the BISI website, in the pricing section. The customer further agrees to pay any applicable charges as specified in this agreement or on the BISI website, which fees and charges are subject to change at any time. Customer acknowledges that there shall be no refunds or credits provided to the customer, expect as expressly set fourth in this agreement.
Customer has the option to pay the total cost of the services at the time of pick-up or in monthly payments. If the customer chooses the monthly payment option, the first payment is due on or before the pick-up date. The customers accounts will then be charged monthly on the anniversary of the pick-up date.
If the customer pays by credit card, the customer hereby authorizes BISI to charge the customers credit card in accordance with the payment plan selected by the customer. In the event that the customers payment cannot be authorized , or a check bounces, all charges associated with this agreement must be paid in full in order to receive your items before the time of there delivery, plus any applicable late fees or other applicable fees and charges.
If the customer fails to pay any account within 60 days after it is due, the customers possessions shall be deemed abandoned, and BIST shall have the right, but not the obligation, to take any reasonable action to dispose of any abandoned property, to recover any outstanding balance from the customer. Customer shall be responsible for any costs incurred by BISI in connection with the disposal of customers property. BISI will have no obligation to disclose information concerning action taken if any, and may still take necessary legal measures to obtain payment for services provided by the customer. BISI shall have no obligation to return any proceeds from the disposal of the customers property, and the proceeds in excess of the outstanding balance owed to BISI under this agreement shall be retained by BISI as liquidated damages.
Limitation on Liability
You have responsibility for, and bear all risk of loss or damage to the boxes and their contents, and for any damage caused to your property or the property of others by the boxes or their contents, and for any damage caused to your property or to the property of others by the boxes or by their contents while the boxes remain in your possession, including while the boxes are on your driveway or loading dock or any other place in your residence.
Subject to the section entitled insurance, following pick-up of your boxes from your residence until the boxes are delivered to you, BISI does not assume any risk for loss or damage to the personal property you have placed in the boxes for storage, no matter how the loss or damage may be caused, except for the loss or damage caused directly by our gross negligence or willful misconduct, and in any event BISI aggregate maximum liability to you shall not exceed the fees you paid for the services.
Customer shall defend, indemnify and hold harmless BISI and its employees, agents and representatives from and against any and all claims, actions, demands, liabilities, damages, costs and expenses (including, without limitation, fees for appropriate legal representation), arising from, in connection with or related to the services provided under this agreement or any breach or default by customer of any agreement, covenant, representation or warranty of customer under this agreement.
Insurance
BISI will insure all items stored during the storage period, up to a maximum of £100 (GBP). Additional insurance can be purchased from BISI at the cost stated on our website. Except as expressly set fourth above, all items stored in the storage facility are at the sole risk and expense of the customer, who is responsible for arranging the appropriate insurance coverage.
BISI does not insure against any damage to: intellectual property ( e.g, computer files); extremely fragile items; improperly packed items; concealed damages; minor damage due to normal handling( e.g, scratches, etc); damages to natural disasters; damage occurring while not in the possession of BISI; any damage occurring without evidence of physical damage to the exterior of the box.
Customer Information
You are required to notify us immediately of any changes to your name, address, contact information, credit card or checking account numbers, by contacting us by phone or through the internet. The customer warrants that any personal information that he or she provides to BISI is truthful, complete and accurate.
If, as a result of your failure to provide us with information, BISI is unable to process any fees or charges payable under this agreement, or if BISI is unable to contact you in the event of an emergency, BISI may deem your property to have been abandoned, and dispose of any such property.
BOXITSTOREIT Refunds Policy
In exceptional circumstances, refunds are given at the discretion of the management.
The Customer may withdraw their custom from BOXITSTOREIT up to seven (7) working days after the order has been submitted; if BOXITSTOREIT provides any service within these 7 days, this right to cancel ends at the time when the service is undertaken on behalf of a Customer.
